Is a current balance sheet provided on the financials page of lesprit.org?
Has the board mailed to L'Esprit owners, or posted in the member section of lesprit.org, the
many lawsuits and court decisions for which LPOA is/was a litigant?
Are LPOA members' funds being recaptured for lawsuits regarding which LPOA prevailed
in court or the litigants against LPOA requested that their lawsuit(s) be dismissed?
Are board members, officers and committee chairpersons solely using LPOA-assigned email
addresses for all official email correspondence?
Is there a signed legal opinion adopted by the board which states that any non-easement
private property in L'Esprit can be self-declared by LPOA volunteers as prescriptive
easement for horseback riding?
Is the corporate secretary posting to lesprit.org the audio recording of every board meeting,
as well as each architectural control committee meeting?
Has an independent safety review been completed on all 20+ miles of L'Esprit bridle path
easements?
Did the board first adopt and distribute to members a signed legal opinion before unilaterally
approving their unprecedented 'fine policy' in August 2023?
Could an LPOA volunteer(s) personally be at risk for directing that a lien be filed against a
tract owner because of non-payment under the board's 'fine policy' if: (1) the board's alleged
statutory authority for that policy doesn't apply to L'Esprit; or, (2) the board didn't adopt a
signed legal opinion before unilaterally approving the policy; or, (3) the decision for imposing
the lien isn't made during a corporate board meeting and reflected in those approved
minutes?
Is there a statute that makes it a felony for someone to file an illegal lien in the
Commonwealth of Kentucky?
What right of action exists for a tract owner who alleges that LPOA has selectively levied a fine
under the board's 'fine policy', but failed to also levy a fine against another tract owner(s) for
the same violation?
How might the board's 'fine policy' impact property values, in terms of prospective buyers' and
realtors' perceptions of L'Esprit?
Is the corporate secretary refusing to send every interested member a roster of tracts and
assessments that LPOA is required to make available, per the bylaws?
Is there a signed legal opinion that was adopted by the board as part of an LPOA policy that
permits volunteers to officially advocate on behalf of LPOA regarding a L'Esprit tract owner's
pursuits that aren't within LPOA's corporate purview?
Could there be potential consequences for LPOA and assigned volunteers if L'Esprit bridle path
signs are posted at locations that aren't recorded bridle path easements and/or if the
published bridle path map includes these non-easement locations?
Has LPOA posted directional and safety signs along the entirety of L'Esprit's 20+ miles of bridle
path easements?
Do LPOA volunteers use the irrelevant term 'trails' when officially referring to L'Esprit's
recorded bridle path easements?
Where are the 15' recorded bridle path easements specifically located along the main branch
of Harrod's Creek, and who legally has authority to make those determinations?

Are any tract owners being allowed to obstruct bridle path easements?
What federal, state and/or local government agencies must approve any land alteration along
the main branch of Harrod's Creek that impacts conservation or watershed preservation?
Does LPOA spend members' funds on maintenance of non-easement private property?
Does the Architectural Control Committee (ACC) refuse to disclose the votes of committee
members regarding every application?
Has any LPOA board member(s) or officer(s) been inappropriately influencing or involved with
ACC decisions that Article 3 of the Declaration exclusively delegates to the ACC?
Has any ACC member(s) been inappropriately influencing or involved with LPOA decisions that
the Declaration exclusively delegates to other persons or committees?
Was a signed legal opinion adopted by the board that allows volunteers to self-interpret the
Declaration's preamble as taking precedent over specific requirements in the Declaration?
Did the maintenance committee actually use the term 'oversights' when referring to
maintenance violations that are required under the Declaration to be corrected?
What corrective actions have been initiated regarding longstanding 'oversights' of
maintenance violations?
What right of action exists for a tract owner who alleges that LPOA has selectively enforced a
maintenance violation by failing to equally enforce the same violation committed by another
